1. SleazySoft Privacy Policy
SleazySoft is committed to protecting and respecting your privacy. The following document discloses our information gathering and dissemination practices for the web site SleazySoft.com. Any questions about this privacy policy may be submitted using our online contact form.
1.1 Information Collected:
1.1.a. Non-Personally Identifiable Information: While visiting our web site, you may have data stored on your hard drive in the form of a website "Cookie." This cookie is simply a text file that stores data to identify your computer to our server. These cookies do not collect any personal information. We may also collect non-personally identifiable information for the sole purpose of creating web site usage statistics.
1.1.b. Personally Identifiable Information: On some pages, a user may be able to enter information that could identify themself. All information is stored on our private and secure server. Information collected may include name, address, telephone number, or e-mail address. We will never sell, give, trade, rent, or lease your personally identifiable information to others.
1.2 How the information is used:
Information gathered will be used only for the purpose of contacting individuals and the carrying out of business. SleazySoft may send out a mailing list to those users who submit their e-mail address for that specific service. E-Mail addresses on this list will never be sold, rented, given, traded, or leased to anyone.
1.3 Third Party Partners:
SleazySoft currently does not, but reserves the right to, work with other companies to provide offers and promotions that may be of interest to it's users. Users will not be contacted about such offers without their indicated willingness to be contacted. Your information will remain secure with SleazySoft and will not be shared.
1.4 Children's Information:
SleazySoft does not publish any content targeted at children, however we are committed to comply with applicable laws and requirements. For example, the United States' Children's Online Privacy Protection Act (COPPA). Children without the consent of their parent or gaurdian should submit no personally identifiable information to SleazySoft web sites. SleazySoft will not knowingly collect from or use any personally identifiable information of children for any purpose.
1.5 Online Scoreboard Systems:
Certain SleazySoft games may include a score upload feature so that you can compete against others players. The data that each game uploads (upload key) is non-personally identifiable information. Upload keys contain statistical data about the associated playing session and sometimes your SleazySoft ID and password. Upload keys are encrypted with 256-bit ciphers to protect against "man-in-the-middle" style attacks. Any attempts at reverse-engineering or modifying upload key structure and/or integrity will result in loss of upload privilege. Any attempts at modifying, mitigating, or bypassing upload key security features will also result in loss of upload privileges. These offenses may also include permanant banning from the SleazySoft website.
2. Terms of Use/Service
Welcome to SleazySoft Terms of Use/Service. These terms and conditions of use apply to and govern your use of SleazySoft's Web site(s) (the "Site") as a passive visitor, as well as the services that SleazySoft provides to participants who sign up with SleazySoft as members ("Members") (such services to be referred to herein as "Services") with a "SleazySoft ID". On this website "Terms of Use" and "Terms of Service" will be used interchangeably to refer to these terms and conditions. For purposes of these terms and conditions of use, the words "you" and "your" shall refer to any visitor to the Site, as well as any Member, as defined above. Your use of the Site or the Services signifies your agreement to be bound by these terms and conditions. If you do not agree to be bound by these terms and conditions of use, you may not access or otherwise use the Site or receive the Services. This represents the entire agreement. No changes may be made to this agreement orally or without express written consent of SleazySoft.
2.1 License to Use the Site:
SleazySoft grants you a non-exclusive, non-transferable, limited right to access, use and display the site and the materials thereon for your personal use only, provided that you comply fully with these terms and conditions of use. You shall not interfere or attempt to interfere with the operation of the Site in any way through any means or device including, but not limited to, spamming, hacking, uploading computer viruses or time bombs, or the means expressly prohibited by any provision of these terms and conditions of use. Except as expressly provided herein or otherwise allowed by SleazySoft, you may not use the site or the services for any commercial purpose.
2.2 Acceptable Use Policy:
As a condition of your use of this Site and the Services, you warrant to SleazySoft that you:
- Will only use this Site and Services for lawful purposes in accordance with these terms and conditions of use;
- Agree and consent to our Privacy Policy;
- Agree not to infringe the proprietary rights, intellectual property rights, rights of publicity or privacy rights of SleazySoft or third parties in connection with your use of the Site;
- Agree to provide us with accurate information, and to update such information in the event that it becomes outdated or inaccurate, as necessary for provision of the - Services to Members through our Site, and to take responsibility for the information you provide;
- Will be responsible for creating and maintaining the confidentiality of your user name and password, and for all activity occurring under your password and Member Account;
- Will not intentionally or unintentionally violate any applicable local, state, national or international law, including but not limited to any regulations having the force of law, while using or accessing the Site or the Services;
- Will not harvest, gather or otherwise collect contact information of other users of the Site or Services, for any purpose including, without limitation, transmitting any unsolicited advertising, junk mail, spam, or chain letters;
- Will refrain from using unlawful, tortuous, profane, vulgar, harassing, abusive, threatening, inflammatory, libelous, defamatory, fraudulent or similarly harmful or discourteous language in any e-mail or form entry created through this Site;
- Will not access or attempt to access unauthorized areas of the Site, tamper with other users' postings, or unreasonably load or burden the Site's servers.
Members who violate these terms and conditions of use, at SleazySoft's sole discretion, may have their Member Account suspended or terminated, and may be prohibited from receiving Services thereafter.
2.3 Monitoring, Editing and Disclosure of User Material:
You agree that SleazySoft has the right, but not the obligation, to monitor all material on the Site at any time for any reason in its sole discretion to determine compliance with these terms and conditions of use and any other operating rules that SleazySoft may establish from time to time. Notwithstanding this right of SleazySoft, SleazySoft does not and can not review all materials posted to the Site by users, and SleazySoft is not responsible for any such materials posted by users. SleazySoft reserves the right at all times to edit, disclose, refuse to post, request removal of or remove any material or information as may be necessary to comply with any law, regulation or government or agency request or if, in SleazySoft's sole discretion, such materials are objectionable or in violation of these terms and conditions of use. SleazySoft does not represent or endorse the accuracy or reliability of any advice, opinion, statement, or other information displayed or distributed through the Site. You acknowledge that any reliance upon any such opinion, advice, statement, memorandum, or information shall be at your sole risk. SleazySoft reserves the right, in its sole discretion, to correct any errors or omissions in any portion of the Site.
2.4 Waiver of trial-by-jury:
The user agrees to a waiver of trial-by-jury. Any dispute not settled will be referred to arbitration. All legal proceedings will be subject to the laws and regulations of the State of New York.
2.5 Indemnification:
You shall indemnify, defend and hold harmless SleazySoft, and all its officers, directors, owners, agents, employees, content providers, partners, affiliates, licensors and licensees (collectively, the "Indemnified Parties") from and against any and all losses, damages, liabilities, and claims and all fees, costs, expenses, of any kind related thereto (including, without limitation, reasonable attorneys' fees) incurred by the Indemnified Parties in connection with any claim arising out of, based upon or resulting from your use of the Site or receipt or use of the Services. SleazySoft reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you and you shall not in any event settle any matter without the written consent of SleazySoft.
2.6 Settlement of Disputes
Any disputed commission payment should be submitted in writing to the administrator at the prescribed address.
2.7 Links to Other Web Sites
The Site may contain links and pointers to other World Wide Web Internet sites, resources, and sponsors of the Site. Links to and from our Site do not constitute an endorsement by SleazySoft or any of its subsidiaries, partners and affiliates of any third party resources or their services or contents. Links do not imply that SleazySoft or the Site sponsors are affiliated or associated with or are legally authorized to use any trademark, trade name, logo or copyright symbol displayed in or accessible through the links, or that any linked sites are authorized to use any trademark, trade name, logo or copyright symbol of SleazySoft or any of its affiliates. SleazySoft is not responsible for content on or services provided by other Web sites that are linked to or from the SleazySoft site, including without limitation SleazySoft's partners' Web sites and services. You should direct any concerns regarding any external link to its site administrator or Webmaster.
2.8 SleazySoft's Rights to Materials Provided by Users:
Any or all material and information provided by you to the Site, including without limitation the information contained in your Member Account, if any, may be included in a database owned by SleazySoft and its subsidiaries, partners and affiliates in which we have rights and interest, including but not limited to, the compilation copyright. We reserve the right to use any information or materials you provide to us or that we obtain through your use of the Site or Services to the fullest extent permitted by law.
By posting messages, uploading files, inputting data or engaging in any other form of communication (individually or collectively "Communications") to or within the Site, you grant to SleazySoft a perpetual, worldwide, irrevocable, unrestricted, non-exclusive, royalty-free license to use (including use for promotional and advertising purposes), copy, license, sublicense, adapt, distribute, display, publicly perform, reproduce, transmit, modify, edit and otherwise exploit such Communications and any ideas or original materials contained in such Communications, in all media now known or hereafter developed, without any compensation to you. This grant shall include the right to exploit any and all proprietary rights in such Communications including, without limitation, any and all rights under copyright, trademark, service mark or patent laws under any relevant jurisdiction. You waive all rights to any claim against SleazySoft for any alleged or actual infringements of any proprietary rights, rights of privacy and publicity, moral rights, and rights of attribution in connection with such Communications. You agree and understand that SleazySoft is under no obligation to use any material or ideas submitted by you in any Communications in any way whatsoever.
2.9 No Responsibility for Transmitted Material:
You acknowledge that transmissions to and from this Site are not confidential and your Communications may be read or intercepted by others. You acknowledge that by submitting Communications to SleazySoft or the Site, no confidential, fiduciary, contractually implied or other relationship is created between you and SleazySoft or any SleazySoft affiliate or subsidiary other than pursuant to these terms and conditions of use. SleazySoft shall not be responsible for the payment of any monies to any party in connection with SleazySoft's use of Communications submitted by you to the Site.
2.10 No Resale / Exploitation:
You understand and agree that you may not reproduce, copy, resell, manipulate, or exploit any part of the Site or Services for any commercial purpose.
2.11 Non-United States Residents:
SleazySoft makes no representation that materials in the Site and their copyrights, trademarks, patents, and licensing arrangements, are appropriate or available for use in locations other than the United States. Those who choose to access this Site from other locations outside of the U.S. do so on their own initiative and are responsible for compliance with local laws, if and to the extent local laws are applicable.
2.12 Termination:
You understand and agree that SleazySoft may, in its sole discretion and at any time, terminate your Member Account, if any, and discard and remove any content or information contained therein, for any reason. SleazySoft may also, in its sole discretion and at any time, discontinue any Services, or limit or restrict any user's access to the Site or the Services, for any reason. You understand and agree that SleazySoft may take any one or more of these actions without prior notice to you, but shall use commercially reasonable efforts to notify you of such termination. You understand and agree that SleazySoft shall not have any liability to you or any other person for any termination of your Member Account or access to Services and/or the removal of such information. Member may terminate its Member Account at any time by sending a request of termination by e-mail to SleazySoft using the supplied contact form.
2.13 General Provisions:
These terms and conditions of use shall be governed by and construed in accordance with the laws of the State of New York, without regard to conflicts of laws provisions. The sole and exclusive jurisdiction for any action or proceeding arising out of or related to these terms and conditions of use shall be an appropriate State or Federal court located in New York County in the State of New York and you hereby irrevocably consent to the jurisdiction of such courts. If for any reason a court of competent jurisdiction finds any provision of these terms and conditions of use, or portion thereof, to be unenforceable, that provision shall be enforced to the maximum extent permissible so as to effect the intent of these terms and conditions of use, and the remainder of these terms and conditions of use shall continue in full force and effect. These terms and conditions of use constitute the entire agreement between you and SleazySoft with respect to the subject matter hereof, and supersede all previous written or oral agreements between the parties with respect to such subject matter. No waiver by either you or SleazySoft of any breach or default hereunder shall be deemed to be a waiver of any preceding or subsequent breach or default. The section headings used herein are for convenience only and shall not be given any legal import.
2.14 Changes to Terms of Service:
SleazySoft reserves the right, at its sole discretion, to change, modify, add or remove any portion of these terms and conditions of use, in whole or in part, or to incorporate service fees for Members, at any time. Changes in these terms and conditions of use will be effective when posted. You agree to review these terms and conditions of use periodically to be aware of any changes. Your continued use of the Site after any changes to these terms and conditions of use are posted will be considered acceptance of those changes.
2.15 Change to Site or Content:
SleazySoft shall have the right for any reason, in its sole discretion, to terminate, change, suspend or discontinue any aspect of the Site or Services, including but not limited to Content, features, or hours of availability. SleazySoft may also impose limits on certain features and Services or restrict your access to parts or all of the Site without notice or liability.
2.16 SleazySoft ID Policies:
SleazySoft IDs are the indvidual membership access accounts to the website and its services. SleazySoft IDs are and remain the property of SleazySoft. SleazySoft reserves the right to cancel, lock, modify, delete, moderate, or restrict access to any SleazySoft ID with reasonable cause. Continued access privileges to your SleazySoft account are contingent on your adherence to the terms and conditions set forth in this document. SleazySoft reserves the right to issue warnings and bans as it sees fit for accounts that are out of compliance from this document. You must be over the age of 14 to create a SleazySoft ID. Personally identifiable information will not be collected unless an age of at least 18 years has been specified. SleazySoft will do its best to remain fair and reasonable in any and all mediation.
2.16.1 Purchased SleazySoft ID Upgrades:
At any given time, members may purchase upgrades for their SleazySoft ID. These upgrades can offer a variety of services and features. Upgrades are offered on an as-is basis with no warranty of any kind. At this time, SleazySoft does not offer refunds on any upgrades under any circumstances. Accounts that are banned, cancelled, terminated, or access restricted that have purchased upgrades will not receive a refund as this indicates a violation of the agreement set forth in this document. Upgrades can not be transferred to different accounts.
2.16.2 Excessive Payment for Upgrades
In the event of an overpayment for an upgrade, the balance will be considered a non-refundable and non-deductible donation to SleazySoft.
2.16.3 Insufficient Payment for Upgrades
If insufficient payment is rendered for an upgrade, the balance will be stored on the account . When the remaining sum is paid the upgrade will be placed on the account. Upgrades will only be enabled on the account when the entire balance is in "pending" or "complete" status. If a transaction fails after being in pending status, the upgrade will be removed from the account until the payment is made. If insufficient payment is made and not used towards an upgrade within 30 days, it will be considered a non-refundable and non-deductible donation to SleazySoft.
2.16.4 Chargebacks and Reversals
In the event of a chargeback, reversal of payment, or payment dispute, the SleazySoft ID in question will automatically be locked and indicate "Banned" status. SleazySoft will conduct an internal investigation to determine whether this status is permanant or not.

4. Cryptographic Export
Some countries have regulations on the use of cryptographics systems; it may be unlawful to use SleazySoft products that use cryptographic algorithms (such as SlzNotes) in these countries. Please do not re-export (i.e. put them on a FTP server located in the U.S.) this software from the United States. The United States administration claims that strong cryptograpy is a kind of ammunition and forbids the export.

exporting cryptography, in particular
for free software projects.

5. Discussion Policies
Discussions taking place through the SleazySoft website reflect the views, opinions, and sentiments of the author only and not of SleazySoft. Depending on the medium, individuals under the age of eighteen (18) years may not be permitted to participate in the discussions. SleazySoft cooperates fully with all law enforcement investigations that require logs of conversations. By posting information to any public medium (eg. forums, antipaste, shoutboxes, chat rooms), there can be no expectation of privacy.
5.1 Forum/ShoutBox Policies
All posts made to the forums on SleazySoft.com express the views and opinions of the author and not those of SleazySoft and its employees. You must be eighteen (18) years of age or older to participate in the forum discussions. These rules take precedence over those seen anywhere else on the forum software.
You agree not to post any abusive, obscene, vulgar, slanderous, hateful, threatening, sexually-oriented or any other material that may violate any applicable laws. Doing so may lead to you being immediately and permanently banned (and your service provider being informed). The IP address of all posts is recorded to aid in enforcing these conditions. You agree that the webmaster, administrator and moderators of this forum have the right to remove, edit, move or close any topic at any time should they see fit. As a user you agree to any information you have entered above being stored in a database. While this information will not be disclosed to any third party without your consent the webmaster, administrator and moderators cannot be held responsible for any hacking attempt that may lead to the data being compromised.
Unsolicited advertisements to a shoutbox or the forums will result in immediate and permanant IP Address banning from the website.
5.2 Chat Room Policies
You must be eighteen (18) years of age or older to participate in the online chat room. You agree not to discuss any abusive, obscene, vulgar, slanderous, hateful, threatening, sexually-oriented or any other material that may violate any applicable laws. Doing so may lead to you being immediately and permanently banned (and your service provider being informed). The IP address of all chatters are recorded to aid in enforcing these conditions.
6. Accessability Policy
Giving everyone equivilent access to the content inside a video game has historically been very difficult. Games are typically rich in content of all types. Visual feedback and text are vital elements in any game, however, it is much more important to the hearing impaired.
While none of the games made at SleazySoft previous to 12/30/2005 included content that made them inaccessible per se, future game development will be carried out with an emphasis on accessability. The basic checkpoints we will adhere to are as follows:
- All spoken dialogue will have closed captioning.
- Important sound effects will have a textual representation either by default or through the use of an option represented in the configuration menu.
- While most if not all games rely heavily on graphical elements, the website will be as screen reader friendly as possible.
- We will do our best to make sure the SleazySoft website also conforms to the W3C standards for accessability.
The game engine we are developing already includes basic structures for facilitating things like closed captioning and 3D sound. We have already taken steps to make this webpage more accessible by conforming to W3C standards in xhtml and css to make screen reader use more consistent. The menu system on the left has been redesigned but we made sure that the method we used was screen reader compatible.
Video games are about fun and accessible video games are about everyone having fun. We will do our best to make sure that all SleazySoft games are as accessible as reasonably possible.
7. End User License Agreement
This End User License Agreement is valid for all SleazySoft products (video games, applications, etc.) downloaded from this website. In case of another EULA appearing in a piece of older software, this one shall take precedence. By using the software, the end user understands and accepts the following:
- The end user accepts that the use of this software is done so at their own risk. By using this software the end user accepts this agreement and risk.
- The end user will not attempt to reverse engineer, decompile, or modify the executable program, game logic and mechanics, flow, or algorithms in any way.
- The end user is free to install and use this software on any computer that they own.
- The end user understands that all information (including all data files, all image files, all sound and all music files, all text documents, all executable files, all dynamic link libraries, and all static libraries) that comes with this application is copyrighted material and is protected under federal law.
- If you do not agree with these terms and conditions you must delete all traces of this software from your computer. You must also destroy or delete your backup copies.
8. RSS Feeds
RSS (really simple syndication) service is a means by which SleazySoft offers feeds of news articles and game features in XML format ("RSS Content") to visitors to SleazySoft.com who use RSS aggregators. These terms govern your use of the RSS service. The use of the RSS service also is subject to the terms and conditions of the SleazySoft Terms of Use, which governs the use of SleazySoft's websites, information services and content.
8.1. Use of RSS Feeds
RSS is a free service offered by SleazySoft to individuals for private, non-commercial use. Any other uses, including without limitation the incorporation of advertising into or the placement of advertising associated with or targeted towards the RSS Content, are strictly prohibited. You must use the RSS feeds as provided by SleazySoft, and you may not edit or modify the text, content or links supplied by SleazySoft.
8.2. Link to Content Pages
The RSS service may be used only with those platforms from which a functional link is made available that, when accessed, takes the viewer directly to the display of the full page on the SleazySoft Site. You may not display the RSS Content in a manner that does not permit successful linking to, redirection to or delivery of the applicable SleazySoft web page. You may not insert any intermediate page, splash page or other content between the RSS link and the applicable SleazySoft web page.
8.3. Ownership/Attribution
SleazySoft retains all ownership and other rights in the RSS Content, and any and all SleazySoft logos and trademarks used in connection with the RSS Service. You must provide attribution to the appropriate SleazySoft website in connection with your use of the RSS feeds. If you provide this attribution using a graphic, you must use the appropriate SleazySoft website's logo that we have incorporated into the RSS feed.
8.4. Right to Discontinue Feeds
SleazySoft reserves the right to discontinue providing any or all of the RSS feeds at any time and to require you to cease displaying, distributing or otherwise using any or all of the RSS feeds for any reason including, without limitation, your violation of any provision of these Terms of Use. SleazySoft assumes no liability for any of your activities in connection with the RSS feeds or for your use of the RSS feeds in connection with your website.
8.5. RSS Feed Abuse
SleazySoft reserves the right to ban individuals who abuse RSS feeds. This includes refreshing feeds faster than their specified time limit. When not specified, that time limit shall be once every thirty (30) minutes. In the event of accidental banning due to a proxy server or routing issue, contact us and we will work with you to figure out how to work out access usage without banning.

10. Adware, Spyware, Malware Policy
SleazySoft STRONGLY OPPPOSES all forms of malware. SleazySoft applications and games will never intentionally jeopardize your privacy or security. All applications and games are designed to be easily removeable from the computer through either an uninstall utility or by deleting the directory. SleazySoft does not employ the use of reinstallers and avoids all features that may be found in any type of malware. No SleazySoft application is designed to collect any personally identifiable information from any user. SleazySoft applications and games do not contain, nor are they bundled with, any third party applications (spyware, adware, malware, etc.) that would jeopardize your security or your privacy.
We make (a little) money through donations and registrations, not by loading down your computer with bundled garbage. SleazySoft's official policy towards such malware is that we would rather go broke than secretly install anything that would endanger a user's privacy or security.
With this said, SleazySoft may, in the future, incorporate advertisements into a game. If this is done, however, you as the end user will always be made fully aware of any marketing features a game may possess. Advertisements would ONLY appear inside the game and no third party advertisement applications would be installed to facilitate the serving of the ads. If the game needs to make a connection back to our website (to update the ads, send statistical information, etc.) it will make you aware and also alert you of the exact non-personally identifiable data that it is sending and to the domain that it is sending the data. SleazySoft will never use personally identifiable information for any advertisement purposes but may use general statistical information to serve targeted advertisements. No data will ever be sent anywhere without the user's approval.
